1. Scope of This Policy

This Privacy Policy applies to personal information that NBD Processing, LLC collects through this website, through email and telephone contact with the plant office, and through the ordinary operation of the batch grind line at 446 E Crown Pointe Dr, Salt Lake City - 84107-6567, United States (US). It applies to visitors to the website, to prospective clients who make an enquiry, to clients whose work is processed on the floor, and to any other person whose information reaches the company in the course of business.

The policy does not apply to information that is not personal, such as aggregate operating statistics, anonymised counts of batches processed, or technical data that cannot reasonably be linked to an individual. It also does not apply to a third party website or service that you reach through a link on our pages. Those services have their own policies, and we encourage you to read them.

Where a client shares information about the customers or employees of the client with us for the purpose of a processing batch, that client remains responsible for the lawfulness of the sharing, and we handle the information only on the documented instructions of the client as described in the section on batch records below.

2. Who Controls Your Information

NBD Processing, LLC is the controller of the personal information described in this policy. The company is a limited liability company with its plant office at 446 E Crown Pointe Dr, Salt Lake City - 84107-6567, United States (US). The company decides why information is collected and how it is used, subject to the rights that this policy describes.

The website and its supporting systems are maintained by the developer NBD Processing. Where the developer acts only on the instructions of the company, the developer is a processor rather than a controller. Questions about the content of this policy, or about the way the company handles personal information, should be sent to the contact address in the final section.

3. Information We Collect

We collect several categories of information, and we try to collect only what we need for a stated purpose. The categories are described below.

Contact and identity details

When you write to us, call the plant office, or submit the contact form on this website, we may receive your name, your email address, your telephone number, your company name, your job title, and the content of your message. If you ask us to open an intake sheet, we also record the details needed to schedule the work, including the scope of the batch and the requested pickup window.

Technical and usage information

When you visit this website, our hosting systems may automatically record limited technical information such as the type of browser you use, the type of device, the pages you request, the date and time of each request, and a truncated network address. We use this information to keep the site running, to diagnose faults, and to understand which pages are useful to visitors.

Batch and operational records

The operation of the batch grind line produces intake sheets, run logs, quality notes, moisture window readings and pickup handover notes. These records may contain the names of client contacts and the names of technicians who worked on a batch. We treat these records as business records and handle them under the retention rules described later in this policy.

Payment and billing details

If a batch is invoiced, we may collect billing contact details, a purchase order reference and limited payment information. We do not store full payment card numbers on our own systems. Card payments are handled by a payment provider that meets the relevant industry standard.

4. How We Obtain Information

Most of the information we hold comes directly from you. You give it to us when you send an email, pick up the telephone, complete a form, sign an intake sheet, or attend a pickup window sitting. Some information comes from the ordinary observations of our technicians as they process a batch, for example a note recording who was present at a handover.

A smaller amount of information arrives automatically from your browser or from our hosting provider, as described in the technical category above. We do not buy personal information from data brokers, and we do not enrich the information you give us with profiles assembled by third parties for marketing purposes.

In rare cases a client may pass us the contact details of a colleague or a carrier who will attend a pickup sitting. When that happens, we ask the client to make sure the person knows their details have been shared, and we use the details only to arrange the sitting.

5. Why We Use Information

We use personal information for purposes that are closely connected to the services we provide. Each purpose below is paired with the kind of information it needs, so that a reader can see why a particular item is collected.

  • To answer enquiries and provide quotations, using your contact details and the content of your message.
  • To open an intake sheet and schedule a batch, using the scope details and requested window you provide.
  • To operate the batch grind line and keep run logs, quality notes and moisture readings accurate, using the operational records described above.
  • To arrange and document pickup window sittings, using the names of the client contact and the carrier who attend.
  • To invoice for completed work and to meet accounting and tax obligations, using billing details and purchase order references.
  • To keep the website secure and working, using limited technical information gathered automatically.
  • To improve our services over time, using aggregate usage information that does not identify an individual.
  • To comply with legal obligations, respond to lawful requests, and defend or establish legal claims.

We do not use your personal information for automated decision making that produces legal effects, and we do not sell personal information to third parties.

6. Legal Bases for Processing

Where the law requires us to identify a legal basis for processing, we rely on one or more of the following. We rely on the performance of a contract when we process information in order to open a batch, operate the line or hand over a finished record. We rely on our legitimate interests when we keep the website secure, improve our services and communicate with prospective clients, provided that those interests are not overridden by your rights. We rely on legal obligation when we keep accounting and tax records or respond to a lawful request. We rely on consent where we send marketing communications that are not covered by an existing client relationship, and you may withdraw that consent at any time.

If you are unsure which basis applies to a particular activity, you may ask us and we will explain it in writing.

7. Cookies and Similar Technologies

This website is intentionally light. It uses a small number of cookies and similar storage mechanisms that are needed for the site to function, such as a session marker that keeps a single visit consistent. These are sometimes called strictly necessary cookies. They do not track you across other websites and they do not build a profile of your interests.

If we introduce analytics that rely on cookies at any point, we will describe them in this section and, where the law requires it, ask for your consent before they are set. You can control cookies through the settings of your browser. Blocking strictly necessary cookies may stop parts of the site from working, but the reading pages of this website will remain available to you.

We do not use advertising cookies, we do not permit third party advertising networks to set cookies on our pages, and we do not participate in cross site behavioural advertising.

8. Batch Records and Intake Sheets

The batch grind line produces a record for every job. An intake sheet records the scope and the requested window. A run log records when the batch entered and left each bench, who was at the controls, and what changed. Quality notes record what was seen and corrected at each stage. Moisture windows record the environmental readings taken with instruments. A pickup handover note records who collected the finished record and when.

These documents may contain the names of client contacts and technicians. We handle them as confidential business records. They are kept at the plant office and, where a system copy exists, on access controlled storage. Access is limited to staff who need the record to do their work, to auditors acting under a lawful mandate, and to the client whose batch the record describes.

When a client shares information about its own employees or customers for the purpose of a batch, we process that information only on the documented instructions of the client. We do not use it for our own purposes, and we return or delete it at the end of the engagement unless the law requires us to keep it.

9. How We Share Information

We share personal information only in the limited circumstances set out below. We do not sell personal information, and we do not rent contact lists to anyone.

  • With service providers who help us run the business, as described in the next section.
  • With professional advisers such as accountants and lawyers, where their advice is required and they are bound by confidentiality.
  • With a carrier or courier that a client appoints to collect a finished batch, limited to the details needed to arrange the pickup.
  • With a public authority or court, where we are required by law or where disclosure is necessary to establish, exercise or defend a legal claim.
  • With a successor in the event that the business is reorganised, merged or transferred, provided the successor agrees to honour this policy.

Where we share information with a service provider, we do so under a written agreement that limits the provider to processing the information for our stated purpose and requires appropriate security measures.

10. Service Providers and Processors

We rely on a small set of service providers to keep the website and the plant office running. These may include a hosting provider that serves the website files, an email provider that delivers and stores plant office correspondence, an accounting provider that issues invoices, and a payment provider that processes card payments. Each of these providers acts on our instructions and is bound to protect the information it handles.

We choose providers with care and review them from time to time. We do not permit a provider to use the information we share for its own marketing. If a provider needs to transfer information outside the country where it was collected, we take reasonable steps to make sure the transfer is lawful and that the information remains protected to a standard comparable with the one described in this policy.

11. International Transfers

The plant office is located in the United States, and our primary records are held there. Some of our service providers operate systems in other countries. Where personal information moves across a border, we take steps to ensure that the receiving jurisdiction offers an adequate level of protection or that an appropriate safeguard is in place, such as a standard contractual clause or an equivalent mechanism recognised by the relevant authority.

If you are located outside the United States and you write to us, you should understand that your message will be handled in the United States. The protections in this policy follow the information wherever it goes, and you may contact us at any time to ask which safeguards apply to a particular transfer.

12. How Long We Keep Information

We keep personal information only for as long as we need it for the purpose for which it was collected, or for as long as the law requires. The periods below give a practical guide.

  • Enquiries that do not become a batch are kept for up to twenty four months so that we can pick up the conversation, and are then deleted.
  • Intake sheets, run logs, quality notes and pickup handover notes are kept for the period required to support the work and any warranty or audit that may follow, which is normally not less than seven years.
  • Billing and tax records are kept for the period required by tax law in the relevant jurisdiction.
  • Technical logs gathered by the website are kept for a short period, normally not more than ninety days, and are then aggregated or deleted.

When a retention period ends, we delete or anonymise the information in a secure manner. If deletion is not possible because the information is held in a backup, we isolate the backup and delete the information at the next cycle.

13. How We Protect Information

We use administrative, technical and physical measures to protect personal information against loss, misuse and unauthorised access. Access to the plant office records is limited to staff who need it. Systems that hold records are protected by access controls and are reviewed periodically. Paper records are stored in locked cabinets at the plant office and are signed out when a technician needs them on the floor.

We train our staff to handle records with care, and we treat the batch records as confidential. No system is perfectly secure, and we cannot promise that a breach will never occur. If a breach occurs that is likely to result in a risk to your rights, we will notify the relevant authority and, where the law requires it, notify you without undue delay.

Please help us protect your information by using a secure connection when you send sensitive material, by not including unnecessary personal data in a general enquiry, and by telling us promptly if you believe an account or a document has been compromised.

14. Your Rights and Choices

Depending on where you live, you may have some or all of the following rights in relation to your personal information. You may ask us to confirm whether we hold your information and to give you a copy. You may ask us to correct information that is inaccurate. You may ask us to delete information that we no longer need, subject to any legal obligation that requires us to keep it. You may ask us to restrict the way we use your information while a concern is investigated. You may object to processing that we base on our legitimate interests. You may ask for a portable copy of information you gave to us.

To exercise a right, contact us using the details in the final section. We will respond within the period required by the applicable law, and we will tell you if we need more information to identify you. If we refuse a request, we will explain the reason and tell you how to complain.

15. Access, Correction and Deletion

A request for access should describe the information you are interested in and, where possible, the batch or enquiry it relates to. We hold a great deal of material at the plant office, and a clear description helps us find the right record quickly. We will not charge a fee for a first request unless the law allows it and the request is manifestly unfounded or excessive.

A request for correction should identify the information that is wrong and the correction you want. Where we agree, we will correct the record in the system and in the copy held at the plant office, and we will tell any provider who holds a copy to do the same. A request for deletion is handled under the retention rules described above. If we cannot delete a record, we will explain why and, where possible, restrict the way it is used.

You may also ask us to stop sending you marketing messages at any time. Instructions for doing so are given in the section on marketing communications below.

16. Privacy for Children

This website and the services described in it are intended for businesses and professional users. They are not directed at children, and we do not knowingly collect personal information from a child under the age of sixteen. If you believe that a child has provided personal information to us, please contact the plant office and we will take steps to delete the information promptly.

Where a batch happens to include information about minors, for example because a client system record contains such information, we treat it as sensitive information and apply stricter access controls, as required by the client instructions and the applicable law.

17. Marketing Communications

We send very little marketing email. From time to time we may send a short note to an existing client about a change to the batch grind line, a new bench procedure, or a seasonal note from the plant office. You can opt out of these messages at any time by replying to the message with a request to stop, or by writing to us directly.

We do not sell or share your contact details with other organisations for their marketing, and we do not use automated systems to send unsolicited bulk email. If you receive a message that claims to come from us and looks suspicious, please forward it to the plant office so that we can investigate.

18. Third Party Websites

This website may link to websites run by other organisations, for example a mapping service used to describe our location or a professional body relevant to our industry. We do not control those websites and are not responsible for their content or their privacy practices. We encourage you to read the privacy notice of any website you visit before sharing personal information with it.

A link from our website does not mean that we endorse the other organisation or its practices. If you find a link on our pages that leads to content you consider inappropriate, please tell us and we will review it.

19. Notice for California Residents

If you are a resident of California, you have specific rights under state law. You have the right to know what categories of personal information we have collected about you, the categories of sources, the business purpose for collection, and the categories of third parties with whom we share it. You have the right to request deletion of personal information we have collected from you, subject to certain exceptions. You have the right to correct inaccurate personal information. You have the right to opt out of the sale or sharing of personal information.

We do not sell personal information and we do not share it for cross context behavioural advertising. We will not discriminate against you for exercising a privacy right. To make a request, contact us using the details below. You may use an authorised agent to make a request on your behalf, provided the agent can show that they are authorised to act for you. We will verify your request before acting on it.

California law also gives residents the right to limit the use of sensitive personal information. The information we process in the course of a batch is generally business information rather than sensitive personal information, but if you believe a batch record contains sensitive personal information about you, you may contact us and we will explain how it is handled.

20. Changes to This Policy

We review this policy from time to time and may update it to reflect a change in our practices, a change in the law, or an improvement in the way we explain our work. When we make a material change, we will update the effective date at the top of the page and, where appropriate, place a short notice on the homepage of this website.

We encourage you to read this policy when you begin a new relationship with us and to check back occasionally. If a change affects the way we handle information that you have already given us, we will take reasonable steps to make sure you are aware of it. Continued use of the website after a change takes effect means that you accept the updated policy.

21. How to Contact Us

If you have a question about this policy, a request to exercise a right, or a concern about the way your information has been handled, please contact the plant office. We take every request seriously and we will respond as quickly as we can.
